No win no fee arrangement – how does this work in a will contest/will claim/probate claim?
In any probate claim or will claim where a party is considering contesting a will, litigation service funding is an extremely difficult issue. Whilst it is sometimes possible obtain funding to contest a will via an existing insurance policy (typically a home insurance policy), in practice this is rare. A no win no fee arrangement offers an acceptable and common place alternative to fund the will claim. It does what it says on the “tin” – a charge can only be raised if the will contest is successful. Invariably most if not all of the costs can be recovered from the opposing party or the estate. |

What happens if I lose a will contest/will claim/probate claim?
Where you are contesting a will or bringing a will claim, a “loss” will usually mean that the claim will cease – you will not have issued court proceedings, your litigation service provider will simply tell you that there is insufficient evidence to bring court proceedings to contest the will and therefore that the will contest or will claim must cease. On a no win no fee arrangement, this will mean that you cannot be charged as the will contest or probate claim has not been “won”. Court proceedings are only issued in relation to a will claim/will contest/probate claim in only the rarest instance. If they appear likely, your litigation service provider should be able to obtain insurance protection against the risk of losing. These policies are only usually provided in tandem with a no win no fee arrangement. They are not usually available in a will contest case where the funding arrangement is other than no win no fee.
